When is a Succession Certificate Required?

Who Can Apply?

Under the Hindu Succession Act, 1956, Class I heirs include: son, daughter, widow, mother, son of pre-deceased son, daughter of pre-deceased son, widow of pre-deceased son, son of pre-deceased daughter, daughter of pre-deceased daughter. All legal heirs should ideally be made parties to the petition.

How to Apply in Agra District Court

Step 1: Prepare a petition under Section 372 of the Indian Succession Act, 1925, addressed to the District Judge, Agra.

Step 2: Include details of: the deceased (name, date of death, last address), the petitioner’s relationship to the deceased, list of all legal heirs, details of assets for which the certificate is required, and a statement that no will exists.

Step 3: Attach required documents: death certificate, relationship proof, list of assets with estimated value, NOC from other legal heirs (if available), and court fee stamp.

Step 4: Pay court fees: The court fee for succession certificate in UP is based on the value of assets. For assets up to Rs. 1 lakh, the fee is approximately 2-3% of the value.

Step 5: The court issues notice in a newspaper and waits for 45 days for objections.

Step 6: If no objections are received, the court grants the succession certificate.
