Employee Rights Under Indian Labour Laws

Minimum Wages in UP

One month’s notice or wages in lieu must be provided. Retrenchment compensation of 15 days wages for every completed year of service is mandatory.

Provident Fund and ESI

Establishments with 20+ employees must register under the Employees Provident Fund Act, 1952. Both employer and employee contribute 12% of basic wages. The ESI Act applies to establishments with 10+ employees in notified areas, providing medical benefits, sickness benefit, maternity benefit, and disability benefit.

Sexual Harassment at Workplace

The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 requires every establishment with 10+ employees to constitute an Internal Complaints Committee (ICC). Complaints must be filed within 3 months of the incident. The ICC must complete inquiry within 90 days.
