Land encroachment is one of the most persistent property issues in Agra. What Constitutes Land Encroachment?

3. Criminal Remedies: Section 441 IPC defines criminal trespass, and Section 447 IPC prescribes punishment of imprisonment up to 3 months and/or fine of Rs. 500. For house trespass (Section 448 IPC), punishment extends to one year imprisonment and fine.

4. Nagar Nigam Action: For encroachment on municipal land in Agra, the Agra Nagar Nigam (Municipal Corporation) has powers to remove encroachments under the UP Municipalities Act. You can file a complaint with the Ward Councillor or the Municipal Commissioner.

Anti-Encroachment Drive in Agra

The Agra Development Authority (ADA) and Agra Nagar Nigam periodically conduct anti-encroachment drives. If your land is being encroached upon, you can bring it to the attention of these authorities along with your ownership documents.

Adverse Possession

An application for temporary injunction under Order 39 Rules 1 and 2 CPC can be filed along with the main suit. The Agra Civil Court typically hears injunction applications on priority and can pass interim orders within 2-4 weeks.
